AMERICAN TELEPHONE & IT (AmTel)
TERMS OF SERVICE
These Terms of Service (“Agreement”) govern the telecommunications and related services (“Services”) provided by American Telephone & IT (“AmTel”) to the Customer.
Disclaimer: The term “American Telephone & IT” and “AmTel” are interchangeable in this TOS. “AmTel” is an abbreviation of “American Telephone & IT”
1. Services
AmTel agrees to provide the telecommunications products and services selected by the Customer, including but not limited to hosted business telephone systems, SIP trunking, VoIP services, internet connectivity, structured cabling, network equipment, security camera systems, maintenance, technical support, and related communications services.
2. Promotional Pricing
Three-Year Promotional Plan
Customers selecting the promotional plan agree to a minimum thirty-six (36) month service term.
Benefits include:
- 50% off the Customer’s current monthly telephone bill during the first twelve (12) months.
- 25% off the Customer’s current monthly telephone bill during Years 2 and 3 and thereafter, provided service remains active.
Month-to-Month Plan
Customers who choose not to enter into a three-year agreement are eligible for AmTel’s standard pricing, which is 25% off the Customer’s current monthly telephone bill with no long-term contract.
Discounts apply only to recurring telephone service charges and do not include taxes, regulatory fees, equipment purchases, installation, shipping, labor, internet service, special construction, or third-party charges unless specifically stated in writing.
3. Billing & Payment
Invoices are due upon receipt unless otherwise stated.
Accounts remaining unpaid for more than thirty (30) days shall incur a late payment charge equal to:
$25.00 per month OR ten percent (10%) of the outstanding balance per month, whichever is greater.
Late fees continue to accrue monthly until the account is paid in full.
Returned payments are subject to a $35 processing fee.
AmTel reserves the right to suspend or disconnect service for delinquent accounts.
4. Early Termination
Customers enrolled in the Three-Year Promotional Plan who cancel service before completing the initial thirty-six (36) month term agree to pay:
- A $250 Early Termination Fee; and
- Repayment of all promotional discounts previously received.
Repayment shall equal the difference between:
- The discounted amount actually paid; and
- AmTel’s standard pricing that would have applied without the promotional discount.
- Any leased equipment must paid off for the full amount of the remaining term, ie; pay off the lease in full.
These amounts become immediately due upon termination and will incur late fees (as explained above) and interest at the rate 24% APR until paid in full.
Failure to pay may result in collection activity, court costs and fees.
5. Equipment
Equipment purchased or leased by the Customer becomes the Customer’s property upon payment in full.
Customers are responsible for loss, theft, abuse, or physical damage to AmTel-owned equipment.
6. Number Porting
Where requested, AmTel will make commercially reasonable efforts to transfer existing telephone numbers.
Successful number transfers depend upon the cooperation of the losing carrier and cannot be guaranteed.
Temporary service interruptions may occur during the porting process.
7. Emergency Calling (E911)
Customers are responsible for providing accurate physical service addresses for all telephones utilizing Enhanced 911 (E911).
Moving telephones without notifying AmTel may result in emergency responders being dispatched to the wrong location.
Customers agree to comply with all applicable emergency calling requirements, including Kari’s Law and Ray Baum’s Act.
8. Service Availability
AmTel strives to maintain reliable service but does not guarantee uninterrupted service.
Service interruptions may occur due to:
- Internet outages
- Utility failures
- Power failures
- Equipment failures
- Natural disasters
- Government actions
- Third-party carrier outages
- Force majeure events beyond AmTel’s control
9. Technical Support
Technical support is available during AmTel’s normal business hours.
The use of our trouble ticket email system is the preferred initial request method. Please email “[email protected]” for the best support.
Emergency after-hours support may be available for qualifying outages.
Certain onsite service calls and customer support resulting from customer-caused or other vendor issues may be billable.
10. Customer Responsibilities
The Customer agrees to:
- Pay invoices when due.
- Maintain internet connectivity and electrical power.
- Protect leased equipment from damage.
- Notify AmTel promptly of service problems.
- Notify AmTel promptly for E911 consideration of phones moved to a different address.
- Provide reasonable access for maintenance and repairs.
- Comply with applicable laws regarding telecommunications and E911 use.
11. Warranty
Equipment manufactured by third parties is covered solely by the manufacturer’s warranty.
AmTel warrants its workmanship for ninety (90) days unless otherwise stated in writing.
12. Limitation of Liability
AmTel shall not be liable for indirect, incidental, consequential, exemplary, punitive, or lost-profit damages.
AmTel’s maximum liability shall not exceed the amount paid by the Customer for the affected monthly service.
13. Privacy
Customer Proprietary Network Information (CPNI) and other confidential customer information will be handled in accordance with applicable federal and California laws.
AmTel does not sell customer information to unrelated third parties.
14. Collections
Customers agree to pay all reasonable collection costs, including attorney’s fees, court costs, collection agency fees, and other expenses incurred by AmTel in collecting overdue balances.
15. Governing Law
This Agreement shall be governed by the laws of the State of California.
Any legal action arising from this Agreement shall be brought in the appropriate state or federal court located within California.
16. Entire Agreement
These Terms of Service, together with any signed proposal, quotation, or service agreement, constitute the complete agreement between the parties and supersede all prior discussions or representations.
No verbal statements shall modify this Agreement.
17. Acceptance
By signing a service agreement, paying an invoice, or using AmTel’s services, the Customer acknowledges that they have read, understand, and agree to these Terms of Service.
